GREENBERG, CPA I am glad to report that summer LeHavre Web Site Address and Email Addresses WWW.QNS.COM | JUNE 2017 | LEHAVRE COURIER 3 is just around the corner and Pool #2 opened on Memorial Day weekend. Unfortunately, the weather was not as nice as we would have liked it to be, but many residents turned out to enjoy the pool, especially on Sunday when we had the DJ and Barbeque. We are looking forward to the opening of Pool #1 on Saturday, June 24th. As a reminder, please hold the date of Thursday, June 28th for our Annual Pool Deck Financial Shareholder Meeting at which time we will be reviewing our finances and 2017/18 budget. I am hoping that many shareholders will be in attendance at this meeting. FINANCIAL: The 10 months ending April 30, 2017 (budgeted versus actual) showed revenues of $13,729,212 (82.99%) of the budgeted amount of $16,544,208 and total expenses of $12,704,689 (80.44%) of the budgeted amount of $15,794,662 as reported by our accountants. CEMENT WORK UNDER THE BUILDINGS: We are tentatively scheduled to commence the cement work under the buildings project on June 26th starting with B#10. We have earmarked the following three buildings to be worked on this year: B#10, B#27 and B#2. HALLWAYS & LOBBIES: We are progressing on the lobby and hallway redecorating project. We have had many meetings with EBK Group Architectural Design representatives to tweak some of the proposed designs. We will be displaying the finished designs in the clubhouse in the near future for all residents to view and comment on. The display will remain in place for a few weeks and we hope that many residents will make an effort to come and take a look. I thank you as always for your continued support. Parking Spaces: I would like to address parking spaces since we have begun the process of updating our files to make sure that we have an “Outdoor Parking Space Agreement” (parking space lease) on file for all spots. We are not planning any changes to anyone’s spot, just simply updating our files. Some residents will have already received a request from Management to sign and return an “Outdoor Parking Space Agreement” to our office. Others will receive a request over the coming weeks if we find we do not have a copy of your lease on file. I am surprised to find that many residents are of the understanding that they own their parking spaces. There are no shares attached to any parking space at Le Havre and that is why the corporation charges a $60 monthly leasing fee for all spots. Most residents will probably recall signing a “Parking Acknowledgement/Right to Transfer Assignment of Parking Space” form at the closing of their apartment purchase. They will also recall paying a transfer fee at that time (the amount having changed over the years). The first paragraph of this form states, “A shareholder shall have the right to pay a one-time fee to transfer the assignment of one (1) pre-existing assigned parking space to a purchaser or sublease approved by the Board of Directors. If the shareholder (purchaser) prefers not to take advantage of the above “Right to Transfer Assignment of Parking Space” option, then the parking space will be turned over to Le Havre Owners Corp.” Of course, if the seller does not have a parking space, this document does not apply. Once an incoming shareholder signs the Parking Acknowledgment/Right to Transfer Assignment form and pays the fee at closing, they have the right to use that particular parking space for as long as they reside at Le Havre. They also have the right to transfer their spot to the purchaser of their apartment should they decide to sell their apartment. Every time a parking space changes ownership (each time an apartment is sold) a Parking Transfer Form must be completed and the appropriate transfer fee must be paid to the corporation at the time of closing. Parking spaces cannot be sold by a shareholder to any person and parking spaces cannot be subleased by any resident. However, if two residents decide to switch parking spaces, that can be done so long as both parties present a letter to Management requesting the switch. Management will update their records accordingly and issue a revised “Outdoor Parking Space” to both parties. If a person decides at any time that they no longer wish to retain their parking space because they no longer drive, cannot afford it, the spot is not in a suitable location, they are having a problem with the trees shedding on it, bird’s droppings from the trees etc., etc., they can return the spot to the corporation at any time and the $60.00 leasing fee will be removed from their maintenance account. This doesn’t happen very often but I just want people to be aware that it is an option. The corporation has no way of rectifying/ resolving the minor issues that I just mentioned since Le Havre has 1,024 apartments but only 965 parking spaces. We sometimes get asked if a car and motor cycle can be parked in a spot and the answer is “no;” only one vehicle is allowed per spot. We encourage all residents to come to the Management Office and obtain parking stickers for their vehicle if they have not already done so. I hope this clarifies the situation, and rest assured, nothing is changing with your spot. It’s just a matter of updating our records and making sure that there is a signed lease for every spot, as required by the corporation. Wishing you a wonderful summer season!
